Adventure-park incidents

Adventure parks may include climbing attractions, aerial features, obstacle courses, zip-style attractions, foam pits, jumping areas, or other active-participation experiences.

When a serious injury occurs, the investigation begins with the same core questions: what happened, what attraction was involved, who operated or controlled it, what evidence exists, and what documents were presented to the participant.

Amusement-facility incidents

A serious injury may also occur at an amusement facility that does not primarily market itself as a trampoline park.

The relevant legal and factual issues depend on the specific attraction and circumstances. The investigation may involve an operator, property owner, equipment company, maintenance provider, or another potentially responsible party.

Preserve the same core information

Whatever the facility calls itself, preserve:

  • Tickets and reservation records
  • Receipts and wristbands
  • Photographs and video
  • Witness information
  • Incident reports
  • Waivers or electronic agreements
  • Emails and text messages
  • Medical information

Laws vary from state to state. Generally speaking, when a child is injured, courts do not enforce a liability waiver signed by a parent or guardian on the child's behalf. Some states, however, do enforce arbitration clauses signed by a parent or guardian in cases involving a child's injury.
